1. The SPRL MCM Group (company no. 0860.080.786), whose office is registered in 1400 Nivelles (Belgium), is a society that sells leisure articles, mainly radio controlled. MCM Group is active in all European countries for the individuals under the commercial name "MCM Racing", "MCM Skyshop", "MCM Slot" & MCM Diorama. Also active for the professionals under the designation "MCM Distribution". The company has a shop and offices located in 1654 Huizingen (Belgium) Stwg naar Alsemberg, 906 (registered office).
2. Except express and written deviation between the parties is the relationship between MCM Group and its customers subject to the current terms and conditions that are applicable and must be accepted by the customer, this assuming that they are in contradiction with his own general or special sales conditions. The fact that MCM Group accept an order or a delivery without explicitly opposition to the general or special conditions of the customer doesn’t mean that MCM Group agrees with the general or special conditions of the customer. The fact that the customer doesn’t receive the current, general conditions in its native language, does not mean that there are not applicable. The general conditions and the MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com and MCMDistribution.com sites, as well as its contents were just made and formatted for the customers located in Belgium, although these can be consulted worldwide. The other customers that are located abroad, should be aware that some provisions of the general conditions do not apply for them, without relying on the void of the totality of the general terms and conditions. MCM Group reserves the right to change or modify the terms and conditions without notifying the client personally, as well as without the fact that the client could claim some compensation. It is therefore the customer's responsibility to check from time to time and see if any changes have been made.
3. The products are sold at the price valid at the time of the passing the order. In the prices are all taxes included. Customers who wish to export the goods can give us the documents of customs with the original invoice and we will refund the VAT on a (European) bank account. Five euro for administrative costs will be charged for this operation. The given prices by email or on our site, the price lists, as well as the description of the products and the photos are only given for information without any commitment to the customer. In this context, MCM Group has only a commitment in relation to the customer after the full payment of their orders.
3bis. Customers who wish to export goods can return the customs documents (DAU form) with the original invoice and we will refund the VAT to a (European) bank account. Five euros of administrative costs are invoiced during this operation.
A sealed customs invoice can also no longer be proof of exportation. Only the DAU form is valid.
4. All purchases are payable in cash. MCM Group accepts in the shop also payment by Bancontact, Mister Cash or Visa. On the internet sites other payment methods are possible, more information on: https://www.mcmracing.com/nl/content/12-betaling. In case of special terms of payment agreed between the partners and in case of non-payment within the time limit, a default interest of 10 % per year will be charged by right and without prior notice. In addition, the amount of each unpaid invoice will be increased by 10% with a minimum of €25,00 without VAT. Reminder fee will also be charged, according to the level of the reminder. First reminder, no cost. Second reminder, €5,00 without VAT. Third reminder, €15,00 without VAT.
All orders placed online must be payed in advance. There will be no order, that is not paid in advance, sent. When ordering an item that is not in stock MCM Group asks an advance payment of min. 30%. Once the item arrives, the client is notified by MCM Group. From then on, the customer has 60 days to take away the ordered products. If delivery is not collected within 60 days, the order will be cancelled and the customer loses all rights to recover his deposit. In case of a credit, f.i. an article that is not available by the order or for a return, is this credit valid in one time or in several times within 6 months. After this delay the credit is lost and the customer loses all his rights.
5. If a customer opens or damages an original packaging of an article, this customer has to buy the item in question.
6. The proof of purchase (invoice or delivery note) serves as the warranty document. For repairs & warranty claims, the customer should contact the MCM Group's customer service department. The item in question must always be accompanied by its proof of purchase and the documents requested by the manufacturer (warranty form, etc.).
The customer will receive telephone support on products that have been purchased on the online sales sites MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com & MCMDistribution.com. However, MCM group requests its customers to first consult the manual accompanying the product or to read the information concerning the product on the website of the manufacturer of the product in question.
7. Cancellation of an order (remote or over the counter) during the processing/shipping/delivery period is not possible. Only a delay of more than 15 days on the announced deadline (see order confirmation) allows the cancellation of the order.
If no deadline is announced (pre-orders, orders in shop), a cancellation will only be possible after a period of 120 days.
7bis. In the case of distance selling, the customer has the right to notify the seller that he renounces the purchase within fifteen (15) working days from the day after the delivery date. However, this renunciation can only take effect if the customer has notified the seller of his intention and if the goods are still in their original packaging, have not been used and are ready for sale. If the customer exercises this option, he must return the goods to MCM Group by all means at his own risk and expense.
8. In the case of a refund, a voucher will be issued unless the customer expressly states that he wants a refund when requesting a cancellation. If a voucher has been issued, a refund on the payment method is no longer possible.
In the event of a refund, the refund will be made by the method of payment of the order & will be limited to the net amounts received by MCM Group. It will be done within a maximum of 15 days from the date of cancellation of the order.
9. Having regard to its capacity as intermediary, MCM Group limites the guarantees of the delivered goods to those awarded by its suppliers. As far as the conditions and the period of this permit, will limit its intervention to the MCM Group replacing defective parts or to refund of the paid sum in the form of a gift card, without the customer being able to claim any form of compensation. MCM Group can in no way be held liable on whether or not to carry out the corresponding obligations by the supply on the warranty, in particular in case of bankruptcy of the vendor. 10. MCM Group has no responsibility for the loss or damage to the equipment or other, of whatever nature, which the customer may suffer as a result of the transport, supply, storage, placement, use or operation of the delivered products. On unlimited way this is damage caused by natural persons, the nature of the buyer or of the persons who come into contact with the goods ordered.
11. Just by the fact to order by phone, by fax, or paper order form and on the Internet site, MCM Group has the right to manage and to use personal data of the customer for internal management of the society. "Internal management of the society" means the administration of the customers, managing the orders, deliveries, invoicing, services, follow-up of the solvency, as well as the marketing and publicity. The customer may at any time request the personal information that MCM Group has included in their file, to consult, correct or delete and this by logging on to its customers account via the website or by writing to the head office. 12. If one of these current conditions would be explained unvalid or not applicable, the other current conditions remains valid and that one condition will be applied as by law adopted measure.
13. The parties accept, in the framework of their relationships, both electronic evidence as per fax.
14. Disputes arising out of the execution, the validity, the interpretation or the performance of the contract or of the present general conditions are subject to Belgian law and fall under the jurisdiction of the courts of Nivelles, Belgium.
