1. MCM Group srl (company number 0860.080.786), whose registered office is located at 1400 Nivelles (Belgium), is a company selling leisure articles, but more particularly radio-controlled scale models. MCM Group is active throughout Europe with private customers under the trade names "MCM Racing", "MCM Skyshop", "MCM Slot" & "MCM Diorama". It also sells to professionals under the name "MCM Distribution". The company has a sales outlet and offices at Stwg naar Alsemberg 906, 1654 Huizingen (Belgium).
2. Unless expressly agreed otherwise in writing between the parties, relations between MCM Group and its customers are subject to these general terms and conditions of sale, which are deemed to have been accepted by the customer. In the event that they conflict with the Customer's general or special terms and conditions of purchase, these general terms and conditions shall apply exclusively. MCM Group never accepts and can never be considered to have accepted the Customer's general or special terms and conditions. Consequently, the fact that MCM Group has accepted an order or delivery without protesting against the stipulations referring to the Client's general or special terms and conditions cannot in any way be taken to mean that the relationship between the parties is governed by the Client's general or special terms and conditions. If documents subsequent to the agreement on the application of the present terms and conditions are presented by the customer and refer to the customer's general or special terms and conditions, the present general terms and conditions of MCM Group remain applicable. The fact that the customer has not received these general terms and conditions in his mother tongue does not in any way exempt him from their application.
The general terms and conditions and the MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com & MCMDistribution.com websites and their contents, although available for consultation worldwide, have been drafted and formatted exclusively for customers located in Belgium. Other customers located abroad should be aware that certain provisions of the terms and conditions may not apply to them, without invalidating the entirety of the terms and conditions, or be invoked by them. MCM Group reserves the right to change or modify its general terms and conditions without notifying the customer personally and without the customer being able to claim any compensation whatsoever. It is therefore the customer's responsibility to check periodically whether any changes have been made.
3. If the products are in stock, they are sold at the price in force at the time the order is placed. Prices include all taxes.
The prices communicated by email or on our website, the price lists, as well as the product descriptions and photos are established and communicated to the customer for information purposes only and are not binding. MCM Group is only liable to its customers once their orders have been paid in full.
3bis. Customers wishing to export goods can return the customs documents (SAD form) with the original invoice and MCM Group will refund the VAT to a (European) bank account. A five euro administration fee will be charged for this operation.
A sealed customs invoice can no longer legally be used as proof of export. Only the valid SAD form is valid.
4. All purchases must be made with immediate payment. MCM Group also accepts payment in shop by Bancontact, Mister Cash, Visa or Mastercard. Other payment solutions are available on its websites; more information is available at https://www.mcmracing.com/fr/content/12-paiement . In the event of special terms of payment agreed between the parties and in the event of non-payment on the due date, interest at a rate of 10% per annum will be payable ipso jure and without prior notice. In addition, the amount of any invoice not paid on the due date will be increased by 10%, with a minimum of €25.00 excluding VAT per invoice. Reminder charges will also be applied, depending on the level of reminder. First reminder, no charge. Second reminder, €5.00 excluding VAT. Third reminder, €15.00 excluding VAT.
All orders on online sales sites are payable in advance. No order will be dispatched unless it has been paid for in advance. When ordering an item that is not in stock, MCM Group requires a deposit of at least 30%. When the article has arrived, the customer will be informed by MCM Group. The customer then has 60 days to collect the goods. If the goods are not collected within 60 days, the order will be cancelled and the customer will lose all rights to recover the deposit.
In the case of a credit note, for example for an order for an item that is no longer available or for a return, it is valid in one go or in part for 6 months. After this period, the credit note is lost and the customer loses all rights.
5. If, in shop, a customer opens or damages the packaging of an item, they are obliged to purchase the item concerned.
6. The proof of purchase (invoice or counter sales delivery note) serves as the warranty document. For repairs and warranty claims, the customer should contact the MCM Group after-sales service. The item in question must always be accompanied by its proof of purchase and the documents requested by the manufacturer (warranty form, etc.).
The customer will benefit from telephone support for the products purchased from the online sales sites MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com & MCMDistribution.com. However, MCM group invites its customers to first consult the manual accompanying the product or to read the information concerning the product on the website of the manufacturer of the product in question.
Except in the case of a guarantee request, items cannot be returned or exchanged.
7. It is not possible to cancel an order during the processing / dispatch / delivery period. An order may only be cancelled if it is more than 15 days late in relation to the stated lead time (see order confirmation).
If no deadline is announced (pre-orders, in-store orders), a cancellation will only be possible after 120 days.
In the event that the parcel is not received by the Customer (wrong address, collection time exceeded, incorrect delivery information, presence, telephone number, etc.) and is returned to MCM, the Customer must, within 15 days of receiving an email from MCM informing him of the situation, decide whether to abandon his order or pay for a second delivery. After 15 days, without any reaction from the Customer, the order is cancelled and the Customer loses all rights.
7bis. In the context of distance selling, in accordance with the law, the customer has the right to notify the vendor that he/she renounces the purchase within fifteen (15) working days from the day following the day of delivery. However, this renunciation will only be effective if :
- the consumer has notified the seller of his intention
- the goods are still in their original packaging,
- they have not been used
- ready for sale.
These conditions are cumulative.
If this option is exercised, the consumer will return the goods to MCM Group, by any means, at his own risk and expense.
8. In the case of a refund, priority will be given to issuing a credit note unless the customer expressly states that he/she would like a refund when making the cancellation request. Once a credit note has been issued, a refund is no longer possible.
In the event of a refund, this will be made by the method of payment used for the order and will be limited to the net amounts received by MCM Group. It will be made within a maximum of 15 days from the date of cancellation of the order.
9. In its capacity as an intermediary, the MCM Group strictly limits the warranties relating to the goods delivered to those granted to it by its suppliers. Insofar as the conditions and scope of the latter allow, MCM Group will in any event limit its intervention to the replacement of defective parts or the reimbursement of the price paid in the form of a purchase voucher, without the customer being able to claim damages. MCM Group may in no way be held responsible for the non-performance by its supplier of its obligations relating to the performance of the guarantee, in particular in the event of the supplier's bankruptcy.

Products sold by MCM are usually guaranteed for at least 1 year except :
- Replacement of consumables and worn parts: tyres, launchers, transmission parts (crown wheel, pinions, cardan shafts), etc.
- Poor product maintenance (poor lubrication, corrosion, exposure to water from non-waterproof products, dirty product).
- Damage specifically mentioned in the product data sheets.
- Defects and their consequences due to intervention by the purchaser or a repairer (dismantling the electric or internal combustion engine, variator, remote control, charger, etc.).
- Consequences of improper use of the product.
- With some manufacturers (Traxxas, HPI, Losi, etc.), modifying the connectors on batteries and drives may invalidate the warranty.
- In the case of LiPo, LiOn and LiFe batteries, any misuse will invalidate the warranty (excessive discharge, incorrect charging, storage rules not followed, etc.).
If the warranty is refused by the manufacturer, in particular for one of the reasons described below, but not only, a minimum handling fee of €30.00 (inc. VAT) will be charged, plus the cost of labour (minimum €60/hour inc. VAT). The equipment will be returned after payment of this amount.
Warranty claims made at the counter will never be shipped after replacement or repair. The Customer has the option of ordering carriage at a charge once the item has been handed in at the counter.
The Customer must inform MCM Group of any lack of conformity within a maximum period of 2 months from the date on which the defect was detected. After this period, any warranty claim will be refused in accordance with the law.
10. MCM Group accepts no liability for any loss or damage, material or otherwise, of any nature whatsoever, which the customer or a third party may suffer as a result of the transport, delivery, storage, placement, use or operation of the products delivered. This includes, but is not limited to, damage to the physical or moral person of the purchaser or persons in contact with the items ordered.
11. By placing an order, the customer irrevocably accepts these general terms and conditions and expressly authorises MCM Group to process his/her personal data, irrespective of the means used to place the order, and to use such data for internal company management purposes. Internal company management" means customer administration, management of orders, deliveries, invoicing, services, monitoring of solvency, marketing and personalised advertising. Customers may at any time request to consult, correct or delete the personal data that MCM Group has stored about them by logging on to their account via the website or by writing to the head office. 12. In the event that a court should declare any of the terms and conditions herein to be invalid or unenforceable, the remaining terms and conditions herein shall remain in full force and effect and such term and condition shall be enforceable to the fullest extent permitted by law.
13. The parties accept, within the framework of their relations, electronic and fax means of proof.
14. Disputes relating to the conclusion, validity, interpretation or performance of the contract or these general terms and conditions shall be governed exclusively by Belgian law and submitted exclusively to the courts of the judicial district of Nivelles, Belgium.
