1. MCM Group srl (company number 0860.080.786), with registered office at 1400 Nivelles (Belgium), is a company selling leisure articles, more specifically radio-controlled scale models. MCM Group operates throughout Europe with private customers under the trade names "MCM Racing", "MCM Skyshop", "MCM Slot" & "MCM Diorama". It also sells to professionals under the name "MCM Distribution". The company has a sales outlet and offices at Stwg to Alsemberg 906, 1654 Huizingen (Belgium).
2. Unless expressly agreed otherwise in writing between the parties, the relations between MCM Group and its customers are subject to these general conditions of sale, which are deemed to be accepted by the customer. In the event of any conflict with the client's general or special conditions of purchase, only these general conditions shall apply. MCM Group never accepts and can never be deemed to have accepted the general or special terms and conditions of the Customer. Consequently, the fact that MCM Group has accepted an order or delivery without protesting against the provisions referring to the general or special conditions of the Customer can in no way be interpreted as meaning that the relationship between the parties is governed by the general or special conditions of the Customer. If documents following the agreement on the application of the present conditions are submitted by the Customer and refer to the general or special conditions of the Customer, the present general conditions of MCM Group remain applicable. The fact that the Customer has not received these general terms and conditions in its native language in no way exempts it from their application.
The terms and conditions and the websites MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com & MCMDistribution.com and their contents, although available for consultation worldwide, have been prepared and formatted exclusively for customers located in Belgium. Other customers located abroad should be aware that some provisions of the Terms & Conditions may not apply to them, without invalidating the entire Terms & Conditions, or may be invoked by them. MCM Group reserves the right to amend or modify its general terms and conditions without personally notifying the customer and without the customer being entitled to claim any compensation whatsoever. It is therefore the customer's responsibility to periodically check whether any changes have been made.
3. If products are in stock, they will be sold at the price applicable at the time the order is placed. Prices include all taxes.
The prices communicated by e-mail or on our website, the price lists, as well as the product descriptions and photos are prepared and communicated to the customer for information purposes only and are not binding. MCM Group is liable towards its customers only after full payment of the order.
3a. Customers wishing to export goods can return the customs documents (ED form) together with the original invoice and MCM Group will refund the VAT to a (European) bank account. A €5 administration fee will be charged for this operation.
A sealed customs invoice can no longer legally be used as proof of export. Only the valid ED form is valid.
4. All purchases must be made in cash. MCM Group also accepts in-store payments by Bancontact, Mister Cash, Visa or Mastercard. Other payment solutions are available on the websites; more information is available at https://www.mcmracing.com/fr/content/12-paiement . In the event of special payment terms agreed between the parties and in the event of non-payment by the due date, interest of 10% per annum shall be payable by operation of law and without prior notice. In addition, the amount of each invoice not paid on the due date shall be increased by 10%, with a minimum of €25.00 excluding VAT per invoice. A reminder fee will also be charged, depending on the level of the reminder. First reminder, no fee. Second reminder, €5.00 excluding VAT. Third reminder, €15.00 excluding VAT.
All orders on online sales sites must be paid in advance. No order will be shipped if not paid in advance. When ordering an item that is not in stock, MCM Group requires an advance payment of at least 30%. Once the item has arrived, the customer will be notified by MCM Group. The customer then has 60 days to collect the goods. If the goods are not collected within the 60 days, the order will be cancelled and the customer will lose all rights to recover the deposit.
In the case of a credit note, e.g. for an order for an item that is no longer available or for a return, it is valid for 6 months at once or partially. After this period, the credit note is lost and the customer loses all rights.
5. If a customer in the shop opens or damages the packaging of an item, he is obliged to buy the item in question.
6. The proof of purchase (invoice or delivery note) serves as the warranty document. For repairs and warranty claims, the customer should contact MCM Group's customer service department. The article in question must always be accompanied by the proof of purchase and the documents requested by the manufacturer (warranty form, etc.). All products are covered by the legal guarantee of 2 years in accordance with Belgian legislation.
Legal guarantee of conformity
All new goods sold to consumers are covered by the statutory two (2) year conformity guarantee, as stipulated in articles 1649bis to 1649nonies of the Belgian Civil Code. This guarantee covers any lack of conformity present at the time of delivery.
The consumer must report any non-conformity to MCM Group within a period of two (2) months from its determination. Legal liability rests with the seller, regardless of any commercial guarantees provided by the manufacturer.
Telephone support is provided to the customer for the product purchased through the online sales sites MCMRacing.com, MCMSkyshop.com, MCMSlot.com, MCMDiorama.com & MCMDistribution.com. However, MCM group invites its customers to first consult the manual accompanying the product or read the information about the product on the website of the manufacturer of the product in question.
Except in the case of a Warranty request, items cannot be returned or exchanged.
7. It is not possible to cancel an order during the processing/shipping/delivery period. An order can only be cancelled if it is more than 15 days late in relation to the specified delivery date (see order confirmation).
If no deadline has been announced (pre-orders, in-store orders), cancellation is only possible after 120 days.
In case the package is not received by the Customer (wrong address, exceeded pick-up time, incorrect delivery information, presence, phone number, etc.) and is returned to MCM, the Customer must decide, within 15 days of receiving an email from MCM informing him of the situation, if he will pay for a second delivery. After 15 days, without any response from the Customer, the order will be cancelled and the Customer will lose all rights.
7a. Within the framework of distance selling, the customer has the right, in accordance with the law, to notify the seller that he renounces the purchase within fourteen (14) calendar days from the day following the day of delivery. However, this renunciation will only be effective if :
- the consumer has informed the seller of his intention
- the goods are still in their original packaging,
- they have not been used
- ready for sale
- the goods must be returned within 14 calendar days after the consumer has notified his wish to withdraw from the contract.

Right of withdrawal
In accordance with the law, consumers have a period of fourteen (14) calendar days from the day after receiving the order to notify MCM Group of their decision to withdraw from the contract. After this notification, the consumer has another fourteen (14) days to return the goods.
The goods must be returned in their original condition, unused and with the original packaging and proof of purchase. The costs and risks of the return are to be borne by the consumer.
If this option is exercised, the consumer will return the goods to MCM Group by whatever means, at his/her own expense and risk.
8. In the event of a refund, priority will be given to issuing a credit note unless the customer expressly informs us at the time of the cancellation request that he/she wishes a refund. Once a credit note has been issued, refunds are no longer possible.
In the event of a refund, it will be made via the payment method used for the order and will be limited to the net amounts received by MCM Group. The refund will take place within a maximum of 15 days from the date of cancellation of the order.
9. The customer benefits from a two-year legal conformity guarantee on new consumer goods, including accessories and fittings, in accordance with articles 1649bis to 1649nonies of the Civil Code. The seller is directly responsible for this, regardless of any limitation imposed by the manufacturer. The customer must inform MCM Group within two months of identifying the defect.
Restriction in professional or competitive use
The legal guarantee of conformity does not apply to sales between MCM Group and professional customers (B2B), nor to products expressly intended for professional use or intensive use in competition.
For sales to consumers, the legal warranty for competitive products applies only to original manufacturing defects, excluding normal wear and tear due to intensive use.

Products sold by MCM typically carry a statutory two-year conformity warranty on new consumer goods, including accessories and supplies except :
- Replacement of consumables and worn parts: tyres, launchers, transmission parts (crown wheel, pinions, drive shafts), etc.
- Poor maintenance of the product (poor lubrication, corrosion, exposure to water of non-water-resistant products, dirty product).
- Damage specifically mentioned in the product data sheets.
- Defects and their consequences resulting from intervention by the buyer or a repairer (dismantling of the electric or internal combustion engine, variator, remote control, charger, etc.).
- Consequences of improper use of the product.
- With some manufacturers (Traxxas, HPI, Losi, etc.), changing the connectors on batteries and drives can void the warranty.
- In the case of LiPo, LiOn and LiFe batteries, any misuse (excessive discharge, improper charging, storage rules not followed, etc.) voids the warranty.
If the guarantee is refused, in particular for one of the reasons described below, but not exclusively, administration costs will be charged for a minimum amount of €30.00 including VAT for administration costs, plus labour costs.
Warranty claims made at the counter are never shipped after replacement or repair. The customer has the option to order transportation on payment after the item is handed in at the counter.
The Customer must notify MCM Group of any lack of conformity within a maximum period of 2 months from the date on which the defect was detected. After this period, any warranty claim will be rejected in accordance with the law.
10. MCM Group accepts no liability for any loss or damage, material or otherwise, of any kind suffered by the buyer or any third party as a result of the transportation, delivery, storage, installation, use or operation of the delivered products. This includes, but is not limited to, damage to the physical or moral person of the buyer or persons coming into contact with the ordered items.
11. By placing an order, the customer irrevocably accepts these general terms and conditions and expressly authorises MCM Group to process his/her personal data, regardless of the way in which the order was placed, and to use these data for internal business management. "Internal business management" means customer administration, management of orders, deliveries, invoicing, services, solvency control, marketing and personalised advertising. Customers may at any time request to see, correct or delete the personal data MCM Group has stored about them by logging into their account via the website or by writing to the head office. 12. In the event that any court declares any of the terms and conditions herein invalid or unenforceable, the remaining terms and conditions herein shall remain in full force and effect and such terms and conditions shall be enforceable to the fullest extent permitted by law.
13. The parties shall accept electronic means of evidence and evidence by fax in the context of their relations.
14. Disputes relating to the formation, validity, interpretation or performance of the contract or these general terms and conditions shall be governed exclusively by Belgian law and submitted exclusively to the courts of the judicial district of Nivelles, Belgium.
These general terms and conditions have been drawn up in accordance with the Code of Economic Law, including the provisions on the right of withdrawal and the legal guarantee of conformity.
